State Capture

David French in NYT writes that Trump is not merely testing limits with a specific purpose, but smashing limits for the sole purpose of breaking limits.
French states that Trump and his MAGA Minions
aim to move beyond historic limits so that they can tear down the present state
of the Union because they don’t care for constitutional restraints and Judicial
or Congressional oversight. Trump himself appears to be daring the Supreme
Court to stop him.
In Executive Functions, Bob Bauer and Jack Goldsmith write that Trump/Musk’s presidential maneuvers are likely an effort to defy Constitutional Authority and any Supreme Court mandates in order to re-make the presidency as the supreme authority in the United States.

The whole point of the present Trump Administration
appears to be, for Trump, with Musk’s aggressive assistance, to be the ultimate
authority of the United States Government.
Trump’s efforts resemble what has been known as ‘State Capture’. In 2016 in South Africa, ‘State Capture’ was the term used to describe a situation where the federal government had been completely co-opted by a group of nefarious billionaires. (Sound familiar?).
Tyler McBrien, Lawfare Editor, tells the story in a Guest Essay, 2/5/25 New York Times.
While some of the particular details
of the ‘South Africa’ story are different than present U.S. circumstances, the
broader ‘State Capture’ scenario and end result are ‘hauntingly familiar’.
Beware.
