I reported yesterday that Acting Deputy Attorney General Emil Bove on Friday ordered Mr. Brian Driscoll, Acting FBI Director, to compile a list of all current and former FBI employees assigned “at any time” to the investigation of the Jan. 6, 2021, riot… . Today, AP reports that two lawsuits were filed in federal court in Washington on behalf of anonymous agents:‘… lawsuits were filed Tuesday in federal court in Washington on behalf of anonymous agents, to demand an immediate halt to the collection and potential dissemination of names of investigators who participated in probes of the Jan. 6, 2021 riot at the U.S. Capitol’   AP

 Also on ‘Deadline’ today, in commenting on DoJ Acting Dep. AG, and Elon Musk’s DOGE, Dahlia Lithwick Slate Sr. Editor remarked, ‘Only the Courts can now Check the Legislative and Executive (Government Branches), for Us.’ She added, ‘We might be talking about The End of Constitutional Democracy as it has operated in this land for the last Two and a half Centuries’.   

I wonder about Ms. Lithwick’s observation: What if DoJ fires some, or all of the Agents? The Agents then, in turn, Sue. The Court Rules in favor of the Agents, and require the Agents be reinstated. Trump and the DoJ are then in Contempt of Court. Who’s going to arrest them?

And, of course, the Supreme Court has ruled that any actions taken by the president in an Official Capacity are, basically, Legal. Leaving no way to enforce the Court Order on behalf of the Agents.

Before the end of the day, the FBI turned over the list of Agents' names to Acting Deputy Attorney General Emil Bove.

Andrew Weismann observed that the AG’s Office would eventually track down the Agents' Names, so there was no point actually, in refusing to comply with the order.
