Posse Comitatus
The Brennan Center for Justice describes the Act -
The Posse Comitatus Act was passed in 1878, amid the resurgence of White Supremacy in the Confederate States after the Civil War.
The Posse Comitatus Act bars federal troops from participating in civilian law enforcement except when expressly authorized by law. This 143-year-old (147j.), law embodies an American tradition that sees military interference in civilian affairs as a threat to both democracy and personal liberty.
Basically, the Act was born of fear of Federal Troops being mobilized in support of local Law Enforcement. And now, that’s exactly what the Trump Administration is trying to implement.
Trump has issued an Executive Order, citing a National Emergency, (Illegal Immigration), as the basis for the need to involve U.S. Federal Troops in ‘Support’ of Local Law Enforcement Agencies.
The E.O. is laced with vague reference to what exactly the limits to ‘Support’ of Local Law Enforcement means. This vague reference lends interpretation to possibly include ‘Support’ for Local Law Enforcement Patrol and Incident Management.
Theoretically, U.S. Troops may be found on Patrol and responding to Incidents. Now the Posse Comitatus Act, can be cited as a defense against such U.S. Troop Domestic Deployment. Such Deployment can also be found to violate the 3rd, 4th, 5th, and 6th, Amendments of the United States Constitution. These Amendments born in the days of the American Revolution by Patriots infuriated with British Troop Deployments as a Police Force living in local American Residences and acting as the local Police Force and subjecting Colonists to Unwarranted Search and Seizure as well as Illegal Detention and Imprisonment.
All these Revolutionary objections now once again come of age with the Trump Administration now pushing for U.S. Troops to serve in ‘Support’ of Local Law Enforcement. So, as President Trump pushes this Executive Order into Our Lives, yet another U.S. Supreme Court hearing looms.
Trump continuously trying to undermine the United States Constitution, and Citizens turning to The United Sates Supreme Court to enforce it. Wonderful.
In yet another interesting development, The Trump Administration, under the stern guidance of the ill-suited Attorney General Pam Bondi, has decided to do away with Justice Department Civil Rights Division.
Numerous Reports, (AP, Reuters, NBC, et al...), report over 100 U.S. Attorneys are leaving the Department, after AG Bondi ordered the Division to abandon its current role as the Nation’s Top Enforcement and Litigation Agent for Civil Rights Violations such as Racial/Religious/Civil Rights Discrimination as well as Law Enforcement Use of Force Cases and Issues. Rather, the AG directs, the DOGE-Style Trimmed Division, should focus more on Gender and Christian Discrimination. Prompting the Departure of more than 100 experienced U.S. Civil Rights Attorneys from the Department. Wonderful.
